Sheriff Says Evidence Obtained Illegally

ALEXANDRIA, La. - A federal judge is taking a closer look at the Ouachita Parish sheriff who is crying foul in a case that accuses him of fraud.      

Sheriff Royce Toney was indicted on nine counts of computer fraud and identity theft, and his trial is set for September.

Toney says that when the investigation began, the employees from the Ouachita Parish Sheriff's Office illegally searched his car, office, desk and locked safe without a warrant.

He has also filed a motion to suppress any evidence the government obtained through those searches.

A magistrate judge has scheduled a court hearing for Toney's case for July 3.
