Lawyers want indictment dismissed in kidnap case

JACKSON, MS (AP) -A man suspected in the kidnapping deaths of his girlfriend and her daughter wants a Louisiana judge to throw out his indictment, saying blacks were excluded from the grand jury pool.

Thomas Steven Sanders, who is white, disappeared and was declared dead in Mississippi in 1994, but resurfaced in the deaths of Suellen Roberts and 12-year-old daughter Lexis, of Las Vegas.

He's charged in federal court in Louisiana with the child's kidnapping death. Her body was found in Catahoula Parish in 2010. Roberts' body was found in Arizona.

Sanders' lawyers say in filings that the indictment should be dismissed because grand jurors were drawn from a 2007 list of registered voters, and that Louisiana historically failed to ensure black voter registration. They say the list, therefore, excluded blacks from jury duty.
